1.1 These general terms and conditions (the “Terms”) govern your access to and use of BLAKIWI Sports Booking Platform W.L.L (CR: 231238) via blakiwi.com and/or any related mobile or web application (the “Platform”), and the services made available through the Platform (the “Services”).
1.2 By creating an account, browsing the Platform, purchasing or redeeming a voucher, using any promotion (including BOGO), or otherwise using the Services, you acknowledge that you have read, understood and agree to be bound by these Terms.
1.3 If you do not agree with these Terms, you must not use the Platform or Services.
2.1 “User” means any person who accesses or uses the Platform and/or Services.
2.2 “Venue” means an independent third-party sports, fitness, or wellness venue listed on the Platform.
2.3 “Voucher” means a promotional voucher issued by BLAKIWI that provides conditional access to a promotional offer at participating Venues, subject to the Voucher Rules displayed on the Platform.
2.4 “Free Introductory Vouchers” means the initial allocation of three (3) vouchers granted by BLAKIWI to eligible Users free of charge.
2.5 “Paid Voucher Packages” means voucher packages purchased by Users directly from BLAKIWI (e.g., packages of three (3) or ten (10) vouchers), subject to package terms displayed at purchase.
2.6 “BOGO” means “Buy One, Get One Free” offers, where the User pays for one eligible entrance/session at the Venue and receives a second entrance/session at no additional cost, subject to eligibility, blackout dates, capacity, and redemption rules.
2.7 “Eligible Time Slots” means off-peak periods defined by the Venue and displayed on the Platform, during which vouchers may be redeemed.
3.1 BLAKIWI is an independent promotional and distribution platform that enables Users to discover Venues and access promotional vouchers and offers.
3.2 BLAKIWI does not own, operate, manage, control or provide any sports, fitness, or wellness services. All services are provided by the relevant Venue.
3.3 BLAKIWI is not a reseller, agent, or merchant of record for Venue services. Any payment for Venue services is made directly between the User and the Venue during the pilot voucher model.
3.4 Venues are independent businesses. Nothing in these Terms creates any partnership, joint venture, agency, employment, or franchise relationship between BLAKIWI and any Venue, or between BLAKIWI and any User.
3.5 Venue rules (including safety rules, access rules, dress codes, age restrictions, and redemption rules) may apply and will be displayed on the Platform and/or communicated by the Venue. Users agree to comply with such rules.
4.1 You must be at least 18 years old to create an account and use the Services, unless the Platform explicitly allows use by a parent/guardian on behalf of a minor.
4.2 If you use the Services on behalf of a minor, you represent and warrant that you are the minor’s parent or legal guardian and you accept full responsibility for the minor’s use of the Services and participation at a Venue.
4.3 You agree to provide accurate information and keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
5.1 Vouchers may be issued by BLAKIWI (including Free Introductory Vouchers) and may be subject to availability, validity periods, usage conditions, and eligibility requirements displayed on the Platform.
5.2 Vouchers do not represent prepaid services, stored value, or cash equivalents. A voucher only provides conditional access rights to a promotional offer at participating Venues.
5.3 Redemption. To redeem a voucher, you must present it through the Platform’s designated redemption method (e.g., QR code, code, or in-app confirmation) and comply with the Venue’s check-in procedures.
5.4 Non-transferable. Unless expressly stated otherwise on the Platform, Vouchers are personal to the User account, non-transferable, and may not be sold, gifted, or assigned to another person.
5.5 Pay at Venue. Where an offer requires payment (including BOGO), you will pay the applicable amount directly to the Venue. BLAKIWI does not collect, process, or settle payments for Venue services under this pilot voucher model.
5.6 On-site validation. Voucher activation or display in the Platform does not guarantee entry. Access remains subject to the Venue’s on-site validation, capacity, applicable rules, and verification of voucher validity and eligibility at the time of redemption. Access may be refused if the User fails to meet Venue rules (age, dress code, safety) or if the voucher is invalid/expired.
5.7 Eligible Time Slots and blackout dates. Voucher redemption may be limited to Eligible Time Slots and may exclude blackout dates as defined by the Venue and shown on the Platform.
6.1 After using Free Introductory Vouchers, you may purchase Paid Voucher Packages directly from BLAKIWI, subject to the package terms displayed at checkout. Paid Voucher Packages grant access rights only and do not constitute payment for venue services.
Paid Voucher Packages must be used within six (6) months from the date of successful payment. Any unused vouchers after this period will automatically expire and shall not be refundable, exchangeable, or extendable, unless required by applicable law.
6.2 Payments for Paid Voucher Packages are made exclusively to BLAKIWI through BLAKIWI’s payment systems. Payment provider terms may apply.
6.3 Venues are not involved in, and bear no responsibility for, the pricing, sale, billing, collection, refunds (if any), or management of Paid Voucher Packages sold by BLAKIWI.
6.4 If your payment fails or is reversed, BLAKIWI may suspend access to purchased vouchers until the issue is resolved.
7.1 BLAKIWI may offer promotions, discount codes, and BOGO offers from time to time. Promotions are subject to availability, eligibility criteria, and additional terms displayed on the Platform.
7.2 Under BOGO, where available, you pay for one eligible entrance/session at the Venue and receive a second entrance/session at no additional cost, subject to Venue rules, Eligible Time Slots, and redemption requirements.
7.3 Promotions and BOGO offers may be modified, paused, or withdrawn at any time, subject to applicable law. Changes will not affect vouchers already redeemed, and will not affect already purchased vouchers except where required for fraud prevention, safety, or Venue closure/force majeure.
8.1 Venue services. Cancellations, rescheduling and any refunds relating to Venue services are handled by the Venue, because the service is provided by the Venue and paid directly at the Venue, subject to the Venue’s policy and applicable law. For clarity, where payment is made directly to the Venue, BLAKIWI cannot process refunds for that payment.
8.2 Voucher packages. Any refunds relating to Paid Voucher Packages purchased from BLAKIWI (if offered under the applicable refund policy) will be handled by BLAKIWI in accordance with the refund policy displayed at the time of purchase and applicable law.
8.2.1 Eligibility for Refund. Users are entitled to a full refund of the purchase price of a Paid Voucher Package (packages of 3 or 10 vouchers) within fourteen (14) calendar days from the date of purchase, provided that no vouchers from the package have been redeemed, activated, or used.
8.2.2 Non-Refundable Conditions. Once a User has redeemed or activated at least one (1) voucher from a Paid Voucher Package, the entire package becomes non-refundable and non-exchangeable, as the service is deemed to have commenced.
8.2.3 Refund Process. To request a refund, the User must contact BLAKIWI support at hello@blakiwi.com within 14-day eligibility period. Approved refunds will be created back to the original payment method used at the time of purchase.
8.2.4 Promotional and Free Vouchers. Free Introductory Vouchers and vouchers obtained through special promotional codes or BOGO (Buy One Get One) offers have no cash value and are strictly non-refundable.
8.3 Expiry and unused vouchers. All vouchers are subject to validity periods as displayed on the Platform and/or at the time of purchase. Without limiting the foregoing:
(a) Paid Voucher Packages are valid for six (6) months from the date of successful payment;
(b) Free Introductory Vouchers are valid for the period specified on the Platform; and
(c) unless required by applicable law, expired vouchers are not refundable, exchangeable, or redeemable for cash or credit.
BLAKIWI reserves the right, at its sole discretion and subject to applicable law, to extend voucher validity in exceptional circumstances, including but not limited to force majeure or Venue closure.
8.4 Taxes and receipts. Payments for Venue services are made directly to the Venue; the Venue is responsible for any applicable taxes and for issuing receipts/tax invoices for such services. BLAKIWI is responsible for any taxes applicable to Paid Voucher Packages sold by BLAKIWI.
8.5 Force majeure / Venue closure. If a Venue is closed or unable to honor vouchers due to force majeure, BLAKIWI may, at its discretion and subject to applicable law, (i) extend voucher validity, (ii) allow redemption at another participating Venue where feasible, or (iii) provide an alternative remedy as communicated via the Platform.
9.1 If you initiate a chargeback for a Paid Voucher Package without first contacting BLAKIWI support, BLAKIWI may temporarily suspend your account and/or voucher access pending investigation.
9.2 If a chargeback is decided in your favor, any related voucher access may be cancelled, and any redeemed benefits may be revoked where reasonably possible and permitted by law.
9.3 If a chargeback is rejected and the payment is confirmed as valid, BLAKIWI may reinstate access subject to fraud controls.
10.1 You must not misuse the Platform or Vouchers (including attempting to duplicate vouchers, redeem outside eligibility, abuse promotions, or interfere with security features).
10.2 You must behave respectfully toward Venue staff and other participants. Venues may refuse entry or remove you for inappropriate behavior in accordance with their rules.
10.3 Where your conduct results in loss, claims, fraud, or damage to BLAKIWI or a Venue, you may be liable as permitted by applicable law.
11.1 You acknowledge that sports and wellness activities can involve inherent risks including injury. You are responsible for assessing whether you are fit to participate and for following all safety instructions provided by the Venue.
11.2 Venues are responsible for the safe operation of their facilities and the delivery of services. BLAKIWI does not supervise or control Venue facilities, equipment, staff, or service delivery.
11.3 Where a Venue requires waivers, medical disclosures, or specific equipment, it is your responsibility to comply. Failure to comply may result in denied entry without refund, subject to the Venue’s policy and applicable law.
12.1 To the maximum extent permitted by applicable law, the Platform and Services are provided on an “as is” and “as available” basis.
12.2 BLAKIWI does not warrant that the Platform will be uninterrupted or error-free, or that Venues will always be available or will honor participation outside the Voucher Rules and Eligible Time Slots.
12.3 To the maximum extent permitted by applicable law, BLAKIWI shall not be liable for:
12.4 To the maximum extent permitted by applicable law, BLAKIWI’s total aggregate liability arising out of or relating to (i) the Platform use or (ii) Paid Voucher Package purchases shall not exceed the amount paid by you to BLAKIWI for the relevant Paid Voucher Package giving rise to the claim.
13.1 To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless BLAKIWI, its affiliates, directors, officers, employees, and agents from and against any claims, losses, liabilities, damages, costs and expenses arising out of:
14.1 All intellectual property rights in the Platform, branding, software, and content (excluding Venue content where stated) belong to BLAKIWI and/or its licensors.
14.2 You may not copy, modify, distribute, reverse engineer, or exploit any part of the Platform except as permitted by applicable law and these Terms.
15.1 Our processing of personal data is described in our Privacy and Cookies Policy, which forms part of these Terms.
16.1 Neither BLAKIWI nor any Venue shall be liable for any delay or failure to perform any obligation under these Terms if such delay or failure results from events beyond its reasonable control (“Force Majeure”).
16.2 Where Force Majeure affects voucher redemption or Venue operations, BLAKIWI may apply reasonable measures (e.g., extend validity, change redemption options) subject to applicable law.
17.1 BLAKIWI may modify these Terms from time to time. Updated Terms will be published on the Platform and will apply from the date of publication. Where required by applicable law, we will provide additional notice and/or obtain consent.
17.2 Voucher Rules updates. BLAKIWI may update voucher eligibility, validity periods, usage limits, Eligible Time Slots, and redemption mechanics. Material changes will be communicated via the Platform (and/or email where reasonably practicable) and will apply from the stated effective date, subject to applicable law.
17.3 Pilot model. The voucher-based partnership model may operate as a pilot for an initial period of 12 months. BLAKIWI reserves the right to modify or discontinue the pilot model, or introduce commissions/fees after the pilot period, with reasonable prior notice.
18.1 We may suspend or terminate your account and/or access to the Platform or vouchers if you breach these Terms, engage in fraud, misuse vouchers, or misuse the Services. We may do so with or without notice where permitted by law, including where necessary for security or fraud prevention.
18.2 Upon termination, access to vouchers may be cancelled or restricted to the extent permitted by applicable law, including where reasonably necessary for fraud prevention, security, misuse, or chargeback handling. Voucher expiry dates and usage limits continue to apply.
18.3 You may close your account at any time through the Platform (if available) or by contacting BLAKIWI support. Account closure does not affect any rights or obligations that accrued before closure, including any ongoing investigations, chargebacks, or amounts owed to BLAKIWI (if applicable).
19.1 These Terms, together with the Privacy and Cookies Policy and any additional terms displayed at purchase/checkout (for voucher packages) and/or applicable Venue rules, constitute the entire agreement between you and BLAKIWI regarding your use of the Platform and Services.
20.1 If any provision of these Terms is held to be invalid, illegal or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.
21.1 No failure or delay by BLAKIWI to exercise any right or remedy under these Terms shall operate as a waiver of that right or remedy.
22.1 These Terms shall be governed by and construed in accordance with the laws of the State of Qatar. 22.2 Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of the State of Qatar, unless mandatory law provides otherwise.
